Memoranda of Understanding (MoU)

Bilateral MoUs

Based on the relevant provisions of the supervisory laws, bilateral and multilateral cooperation agreements, i.e. Memoranda of Understanding (MoUs), may be concluded between the FMA and foreign supervisory authorities in the banking, insurance and securities sectors. These agreements, which do not alter the respective legal framework for the FMA’s supervisory activities, make the FMA’s practical supervisory activities in the case of cross-border transactions simpler and swifter. They also serve as a confidence-building measure, towards non-EEA Member States in particular, and as an important instrument in the FMA’s efforts to continually strengthen operative cooperation with its sister authorities, mainly those situated in CEE countries. In essence, they set out the details applicable to the respective tasks and the obligations to establish contact with and inform the other supervisory authority in a practice-oriented manner, and form the basis for regular meetings of the authorities involved.

Multilateral MoUs

In 2008, the MoU on crisis management concluded between the banking supervisory authorities, the central banks and the finance ministries of the European Union in June 2005 was extended and updated. The MoU 2008 ("Memorandum of Understanding on Co-operation between Banking Supervisors, Central Banks and Finance Ministries of the European Union on Cross-Border Financial Stability") entered into force on June 1, 2008.
