FMA Report on Supervision of Capital Markets Prospectuses Q2 2018: FMA approved 20 prospectuses and 43 supplements

The number of prospectuses approved by the Austrian Financial Market Authority (FMA) in the second quarter of 2018 stood at 20, four less than in the second quarter of 2017 (-16.7%). During the comparable period there was also a decrease in the final terms received by the FMA in conjunction with approval base prospectuses from 2,024 to 1,880, a fall of 7.11% The number of supplements approved by the FMA at the same time increased from 26 to 43, which constitutes an increase of approximately 65.4%. One application for the approval of a prospectus was withdrawn. The gross issue volume for interest-bearing securities issued by Austrian issuers stood at € 17.48 billion in the second quarter of 2018 and therefore was markedly lower than the € 25.55 billion in the second quarter of 2017 These findings have emerged from the Quarterly Report on the Supervision of Capital Market Prospectuses, which was published today by the Austrian Financial Market Authority (FMA).

Broken down into various different categories of prospectuses, the distribution was as follows during the 2nd Quarter 2018: Equity securities prospectuses 1 (Q2 2017: 4), base prospectuses 17 (Q2 2017: 20) and bonds 2 (Q2 2017: 0).

The submission of a notification to the respective competent national authority is a condition for being allowed to use a prospectus or a supplement in another EEA Member State. Partner authorities notified the FMA in the 2nd Quarter of 2018 of 120 prospectuses (Q2 2017: 136) and 260 supplements (Q2 2017: 269). The FMA provided notifications about 11 prospectuses (Q2 2017: 14) and 16 supplements (Q2 2017: 11).

The FMA did not impose any administrative penalties in the second quarter of 2018 (Q2 2017: 6), in response to infringements of the Capital Market Act, but did report one case to the public prosecutor’s office (Q2 2017: 2).
