Legal enquiries in relation to financial sanctions may only be submitted via the <a href=\"https:\/\/webhost.fma.gv.at\/IncomingPlattform\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Incoming Platform<\/strong><\/a>. Further information about how to register for the Incoming Platform and details about contact persons can be found on the <a href=\"https:\/\/www.fma.gv.at\/en\/banks\/incoming-platform\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Incoming Platform<\/strong><\/a>.<\/p><h2 class=\"wp-block-heading\">Applications to release frozen funds (Asset Freeze)<\/h2><p class=\"wp-block-paragraph\">With effect from 01.01.2026, the FMA is responsible for the release of certain frozen funds in accordance with the exceptions contained in the respective sanctions regulations (e.g. Articles 4 to 7 of Regulation (EU) No 269\/2014 as amended). Applications for releasing of frozen assets are to be submitted exclusively to the FMA as the competent authority via the <a href=\"https:\/\/webhost.fma.gv.at\/IncomingPlattform\/\"><strong>Incoming Platform<\/strong><\/a>. Further information about how to register for the Incoming Platform and details about contact persons can be found on the <a href=\"https:\/\/webhost.fma.gv.at\/IncomingPlattform\/\"><strong>Incoming Platform<\/strong><\/a>.<\/p><h2 class=\"wp-block-heading\">Reporting obligation for sanctioned persons &ndash; notification in accordance with Article 9 of Regulation (EU) No 269\/2014 as amended<\/h2><p class=\"wp-block-paragraph\">Persons affected by the asset freeze (sanctioned pensions) are required to notify the FMA as the competent authority immediately about all assets that are attributable to them that are held at Austrian credit and financial institutions. The FMA has made a separate <a href=\"https:\/\/webhost.fma.gv.at\/IncomingPlattform\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>web form available on the Incoming Platform<\/strong><\/a> for such notifications. Further information about how to register for the Incoming Platform and details about contact persons can be found on the <a href=\"https:\/\/webhost.fma.gv.at\/IncomingPlattform\/\"><strong>Incoming Platform<\/strong><\/a>.<\/p><p class=\"wp-block-paragraph\">Pursuant to Article&nbsp;9 (2) points a and b Regulation (EU) No 269\/2014 as amended, the natural or legal persons, entities or bodies listed in Annex I are obliged to,<\/p><p class=\"wp-block-paragraph\">a) report before 1 September 2022 or within 6 weeks from the date of listing in Annex I, whichever is latest, funds or economic resources within the jurisdiction of a Member State belonging to, owned, held or controlled by them, to the competent authority of the Member State where those funds or economic resources are located; and<\/p><p class=\"wp-block-paragraph\">b) cooperate with the competent authority in any verification of such information. Failure to comply with the reporting requirement in accordance with Article 9 (2) point a Regulation (EU) No 269\/2014 as amended will be considered as participation in activities in accordance with Article 9 (1) (EU) No 269\/2014 as amended with the object or effect of circumventing the measures referred to in Article 2.<\/p><p class=\"wp-block-paragraph\">In order to be able to monitor the observance of the reporting obligation in accordance with Article 9 (2) point a Regulation (EU) No 269\/2014 as amended, <strong>funds<\/strong> held at Austrian credit or financial institutions are required to be notified by persons listed in Annex l of Regulation (EU) No 269\/2014 as amended. The funds are required to be reported by the natural or legal persons, entities or bodies listed in Annex I Regulation (EU) No 269\/2014 as amended by <strong>31.08.2022<\/strong> at the latest or <strong>within six weeks from the date of listing in Annex I of Regulation (EU) No 269\/2014 as amended<\/strong> to the FMA by means of the web form.<\/p><p class=\"wp-block-paragraph\">Please note that the only <strong>funds<\/strong> that are held at Austrian financial market participants are required to be notified to the FMA as the competent authority. Reporting regarding &ldquo;economic resources&rdquo; are required to be submitted to the Federal Ministry of the Interior\/Directorate National Security and Intelligence Service. The ministry has compiled a detailed list for the <a href=\"https:\/\/www.dsn.gv.at\/407\/\" target=\"_blank\" rel=\"noopener\" class=\"external\">reporting obligations for sanctions<\/a>.
