In this regard the Guidelines and Recommendations and other measures passed by resolution that are issued by the European Banking Authority (<abbr title=\"European Banking Authority\">EBA<\/abbr> ) must be applied. In addition the warnings and recommendations passed by the European Systemic Risk Board (<abbr title=\"European Systemic Risk Board\">ESRB<\/abbr> ) must also be complied with. <div class=\"card\">  <div class=\"card-header\" id=\"heading-6a47327696d82\">    <h2 class=\"mb-0\">      <button class=\"btn btn-link btn-block text-left p-0 d-flex align-items-center justify-content-between\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse-heading-6a47327696d82\" aria-expanded=\"false\" aria-controls=\"collapse-heading-6a47327696d82\">        <span>Application for Supervisory Authorities<\/span>        <i class=\"fa-solid fa-chevron-down text-primary\" aria-hidden=\"true\"><\/i>      <\/button>    <\/h2>  <\/div>  <div id=\"collapse-heading-6a47327696d82\" class=\"collapse\" aria-labelledby=\"heading-6a47327696d82\">    <div class=\"card-body\"><p> Against this background, it is necessary to note, that the FMA takes into account the Guidelines and Recommendations issued by <abbr title=\"European Banking Authority\">EBA<\/abbr>  since 1 January 2011, as the legal successor to <abbr title=\"Committee for European Banking Supervision\">CEBS<\/abbr>  in its enforcement activities within the corresponding legal framework. These also include the Guidelines and Recommendations issued by <abbr title=\"Committee for European Banking Supervision\">CEBS<\/abbr>  until 31.12.2010 that are still in force.     <\/div>  <\/div><\/div><p> <div class=\"card\">  <div class=\"card-header\" id=\"heading-6a47327696e17\">    <h2 class=\"mb-0\">      <button class=\"btn btn-link btn-block text-left p-0 d-flex align-items-center justify-content-between\" type=\"button\" data-toggle=\"collapse\" data-target=\"#collapse-heading-6a47327696e17\" aria-expanded=\"false\" aria-controls=\"collapse-heading-6a47327696e17\">        <span>Application for the Banking Industry<\/span>        <i class=\"fa-solid fa-chevron-down text-primary\" aria-hidden=\"true\"><\/i>      <\/button>    <\/h2>  <\/div>  <div id=\"collapse-heading-6a47327696e17\" class=\"collapse\" aria-labelledby=\"heading-6a47327696e17\">    <div class=\"card-body\"><p> In accordance with Article 16 (3) of the <abbr title=\"European Banking Authority\">EBA<\/abbr>  Regulation, the Guidelines and Recommendations published by <abbr title=\"European Banking Authority\">EBA<\/abbr>  are also to be applied by the banking industry. Furthermore, the FMA also expects that the Guidelines and Recommendations previously published by <abbr title=\"Committee for European Banking Supervision\">CEBS<\/abbr>  are also taken into account accordingly by the banking industry. The FMA makes all EBA Guidelines published to date available for download in both German and English language versions (as far as available). The Guidelines and Recommendations issued by EBA and other related measures can also be found on the <a href=\"https:\/\/www.eba.europa.eu\/regulation-and-policy\" target=\"_blank\" rel=\"noopener\" class=\"external\"><abbr title=\"European Banking Authority\">EBA<\/abbr>  website in the &ldquo;Regulation and Policy&rdquo; section<\/a> under the corresponding topic.
