Pursuant to Article 4 para. 7 first sentence of the Bankwesengesetz (BWG; Banking Act) or Article 64 para. 9 Zahlungsdienstegesetz (ZaDiG; Payment Services Act), the Austrian Financial Market Authority (FMA) may disclose to the general public by publication on the Internet, in the official gazette “Amtsblatt zur Wiener Zeitung”, or in any other newspaper with nationwide circulation, that a particular natural or legal person (person) is not entitled to carry out certain banking transactions, provided that said person has given cause for such action and informing the general public is deemed necessary and reasonable with regard to possible disadvantages of the person concerned.<\/p>
By publication in the official gazette “Amtsblatt zur Wiener Zeitung” of 15 October 2016, the FMA hereby informs, that<\/p>

The provider is therefore neither permitted to conclude money lending agreements on a commercial basis as well as to grant monetary loans (lending business pursuant to Article 1 para. 1 no. 3 BWG) nor to execute credit transfers including for standing orders (payment transaction business in the form of transfer business pursuant to Article 1 para. 2 no. 2 point c ZaDiG).<\/p> <\/p> ANNOUNCEMENT in the official gazette “Amtsblatt zur Wiener Zeitung” of 9 November 2016<\/strong><\/p> Pursuant to the fourth sentence of Article 4 para. 7 of the Banking Act (BWG – Bankwesengesetz) or the first sentence of Article 64 para. 10 of the Payment Services Act (ZaDiG – Zahlungsdienstegesetz) the party subject to the publication may make an application to the FMA to the review the lawfulness of the publication.
