{"id":39225,"date":"2022-06-08T16:49:41","date_gmt":"2022-06-08T14:49:41","guid":{"rendered":"https:\/\/www.fma.gv.at\/bekanntmachung-fma-verhaengt-sanktion-gegen-privatanleger-wegen-verstosses-gegen-das-verbot-der-marktmanipulation-8\/"},"modified":"2026-01-26T10:35:18","modified_gmt":"2026-01-26T09:35:18","slug":"announcement-fma-imposes-sanction-against-kurt-ublacker-for-unauthorised-deposit-taking-business","status":"publish","type":"post","link":"https:\/\/www.fma.gv.at\/en\/announcement-fma-imposes-sanction-against-kurt-ublacker-for-unauthorised-deposit-taking-business\/","title":{"rendered":"Announcement: FMA imposes sanction against Kurt \u00dcblacker for unauthorised deposit-taking business"},"content":{"rendered":"<?xml encoding=\"utf-8\" ?><p class=\"wp-block-paragraph\">A fine of &euro; 30,000 was imposed upon Kurt &Uuml;blacker for unauthorised deposit-taking business in an administrative decision dated 18.05.2022.<\/p><p class=\"wp-block-paragraph\">Pursuant to Article&nbsp;22c para.&nbsp;1 no.&nbsp;2 of the Financial Market Authority Act (FMABG; Finanzmarktaufsichtsbeh&ouml;rdengesetz), the Austrian Financial Market Authority (FMA) may in imposing a sanction that has been imposed as a result of breaches of among other provisions Article&nbsp;98 para.&nbsp;1a of the Austrian Banking Act (BWG; Bankwesengesetz), disclose the name of the persons or entities upon whom a sanction has been imposed, as well as information about the sanction imposed.<\/p><p class=\"wp-block-paragraph\">The FMA therefore announces that a penal order with a fine of &euro; 30,000 in total was imposed against Kurt &Uuml;blacker as person responsible at the time of the offence occurring of &Uuml;blacker Handels GmbH with its registered office in Winklarn, for a breach against Article&nbsp;98 para.&nbsp;1a BWG in conjunction with Article&nbsp;1 para.&nbsp;1 no.&nbsp;1 first case BWG (receiving of funds from other parties for the purpose of management). The penal order is final.<\/p><p class=\"wp-block-paragraph\"><strong>Additional information dated 21.01.2026<\/strong><\/p><p class=\"wp-block-paragraph\"><strong>Application to review the legality of the publication dated 08.06.2022 regarding Kurt &Uuml;blacker<\/strong><\/p><p class=\"wp-block-paragraph\">With regard to the publication dated 08.06.2022 pursuant to Article 22c para. 1 no. 2 of the Financial Market Authority Act (FMABG; Finanzmarktaufsichtsbeh&ouml;rdengesetz) regarding Kurt &Uuml;blacker on the website of the FMA and on the Federal Government&rsquo;s Electronic Announcements and Information Platform (EVI; Elektronische Verlautbarungs- und Informationsplattform), Kurt &Uuml;blacker has submitted an application to review the legality of the publication pursuant to Article 22c no. 2 FMABG.<\/p><p class=\"wp-block-paragraph\">In such an event, the FMA shall also publish in the same manner about the initiation of such a procedure.<\/p><p class=\"wp-block-paragraph\">The FMA is therefore reviewing the legality of the publication dated 08.06.2022 in a procedure to be concluded by issuing an administrative decision.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>FMA imposes sanction against Kurt \u00dcblacker for unauthorised deposit-taking business<\/p>\n","protected":false},"author":60,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"inline_featured_image":false,"footnotes":""},"categories":[85],"tags":[],"class_list":["post-39225","post","type-post","status-publish","format-standard","hentry","category-sanction"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
