{"id":51276,"date":"2024-08-16T16:20:22","date_gmt":"2024-08-16T14:20:22","guid":{"rendered":"https:\/\/www.fma.gv.at\/?p=51276"},"modified":"2024-09-05T11:16:39","modified_gmt":"2024-09-05T09:16:39","slug":"euram-bank-fma-appoints-temporary-administrator","status":"publish","type":"post","link":"https:\/\/www.fma.gv.at\/en\/euram-bank-fma-appoints-temporary-administrator\/","title":{"rendered":"The Austrian Financial Market Authority (FMA) has today appointed Gerd Konezny to assist the Management Board of \u201cEuram Bank AG\u201d as temporary administrator under BaSAG by means of an administrative decision."},"content":{"rendered":"<?xml encoding=\"utf-8\" ?><p class=\"wp-block-paragraph\">The Austrian Financial Market Authority (FMA) has today appointed the external auditor and attorney at law, Gerd Konezny, W&auml;hringerstra&szlig;e 16\/20, 1090 Vienna, with immediate effect by means of an administrative decision to assist the Management Board of the licensed credit institution &ldquo;European American Investment Bank AG&rdquo; (Euram Bank AG), with its registered office at Schottenring 18, 1010 Vienna, as a temporary administrator pursuant to Article&nbsp;46 of the Bank Recovery and Resolution Act (BaSAG; Bundesgesetz &uuml;ber die Sanierung und Abwicklung von Banken).<\/p><p class=\"wp-block-paragraph\">The appointment of a temporary administrator constitutes an early intervention measure and allows the FMA to counteract actual or potential breaches against provisions under supervisory law at the earliest possible stage. The duty of the temporary administrator is to exercise all powers that have been conferred to them, to advance solution for ensuring the observance of supervisory law. For this purpose, the directors of the Bank are instructed by means of an administrative decision to cooperate with the temporary administrator and to in particular actively involve him in an operative manner in all agendas and competences in accordance with Euram Bank AG&rsquo;s Rules of Procedure. In addition, the management board is required for significant transactions to obtain the approval of the temporary administrator prior to taking a decision.
