Prohibition of Distribution of “Emerald Global Energy Transformation Fund (Ireland)”

The Austrian Financial Market Authority (FMA) announces pursuant to Article 31 para. 4 in conjunction with Article 50 para. 2 no. 5 of the Alternative Investment Fund Managers Act (AIFMG; Alternative Investmentfonds Manager-Gesetz), published in Federal Law Gazette I No. 135/2013 as amended, that it has prohibited the further marketing in Austria of units in the foreign alternative investment fund (AIF) “Emerald Global Energy Transformation Fund (Ireland)”, an investment compartment of the “Emerald Innovation Fund ILP, managed by the alternative investment fund manager (AIFM) "TMF Fund Management (Ireland) Limited”, with effect from 24.07.2026, due to its failure to pay annual fees for 2026 in Austria. At the beginning of every calendar year, at least by the 15th January, an annual fee is required to be paid for every authorised AIF as at the cut-off point, for the scrutiny of submitted information and documents that are relevant to the fund (for example an updated prospectus). The FMA is required to prohibit the further distribution of units in an EU-AIF in Austria, if the fee was not paid promptly.
