The European Securities and Markets Authority (ESMA) has published its consolidated report on administrative penalties and measures imposed in EU Member States. In 2025, the financial sectors within ESMA’s scope imposed a total of 955 administrative sanctions measures.

The report highlights the strong position of the Austrian Financial Market Authority (FMA) in comparison with Europe as a whole. Austria imposed just under four percent of all administrative sanctions and measures in the European Economic Area (EEA), indicating higher than average activity in enforcement. The FMA’s measures are spread across a broad spectrum of legal materials covering capital market and supervisory law. It is particularly worth highlighting the successful usage of the accelerated conclusion of proceedings in 2025 as well as the FMA’s role in implementing the new supervisory framework for crypto-assets: in 2025, Austria was one of only four EEA countries, to have already taken specific enforcement measures on the bases of the European Markets in Crypto-Assets Regulation (MiCAR). This confirms the FMA’s ability of integrating new regulatory requirements into supervisory practice at an early stage, and contributing towards an effective implementation of European standards.
