Notification of a prospectus (EU passport)

A securities prospectus approved by the FMA allows the dissemination of a public offering of securities in other Member States in the European Economic Area (EEA), or to apply for authorisation to a regulated market. Upon receipt of the request the FMA informs the competent authority in the respective Member State (notification). Securities prospectuses, which have been approved by a sister authority of the FMA in another Member State, may also be notified to Austria by means of the EU passport. It is therefore also possible for issuers from other EU Member States to make public offerings in Austria.

Such a notification is not however possible for simplified prospectus pursuant to Annex F of the Capital Market Act (KMG).
