ANNOUNCEMENT
On 20.10.2023 an announcement was published on the Federal Government’s Electronic Announcements and Information Platform (EVI; Elektronische Verlautbarungs- und Informationsplattform) and the FMA website pursuant to Article 4 para. 7 of the Austrian Banking Act (BWG; Bankwesengesetz) as well as Article 94 para. 9 of the Payment Services Act 2018 (ZaDiG 2018; Zahlungsdienstegesetz 2018) in relation to WOIN8 LTD.
Pursuant to the fourth sentence of Article 4 para. 7 of the Austrian Banking Act (BWG; Bankwesengesetz) or the first sentence of Article 94 para. 10 of the Payment Services Act 2018 (ZaDiG 2018; Zahlungsdienstegesetz 2018) the party subject to the publication may make an application to the FMA to the review the lawfulness of the publication. In this case, the FMA shall announce the initiation of such proceedings in a similar manner.
WOIN8 LTD made such an application to review the lawfulness of the publication dated 20.10.2023.
The lawfulness of the publication of 20.10.2023 shall therefore be reviewed by the FMA in a procedure to be concluded by means of an administrative decision.
