This provider is not authorised to carry out banking transactions in Austria that require a licence. Therefore the acceptance of funds from other parties for the purpose as deposits pursuant to Article 1 para. 1 no. 1 second case BWG is not allowed.
The basis for this publication is Article 4 para. 7 of the Austrian Banking Act (BWG; Bankwesengesetz).

Application to review the legality of the publication dated 09.11.2023 regarding Yieldnodes / Exceptional Media Limited
With regard to the publication dated 09.11.2023 pursuant to Article 4 para. 7 of the Austrian Banking Act (BWG; Bankwesengesetz) on the website of the FMA and on the Federal Government’s Electronic Announcements and Information Platform (EVI; Elektronische Verlautbarungs- und Informationsplattform), Exceptional Media Limited has submitted an application to review the legality of the publication pursuant to Article 4 para. 7 fifth sentence BWG.
In such an event, the FMA shall also publish in the same manner about the initiation of such a procedure.
The FMA is therefore reviewing the legality of the publication dated 09.11.2023 in a procedure to be concluded by issuing an administrative decision.

Administrative decision about the legality of the publication dated 09.11.2023
regarding Yieldnodes / Exceptional Media Limited
With regard to the publication dated 09.11.2023 pursuant to Article 4 para. 7 of the Austrian Banking Act (BWG; Bankwesengesetz) on the website of the FMA and on the Federal Government’s Electronic Announcements and Information Platform (EVI; Elektronische Verlautbarungs- und Informationsplattform), Exceptional Media Limited has submitted an application to review the legality of the publication pursuant to Article 4 para. 7 fifth sentence BWG.

The legality of the published was determined by means of an administrative decision dated 28.05.2024.

Exceptional Media Limited has submitted an appeal to the Federal Administrative Court (BVwG; Bundesverwaltungsgericht) against the FMA’s administrative decision dated 08.07.2024.
