Risikoländer
Verpflichtete des FM-GwG haben bei natürlichen oder juristischen Personen, die in Drittländern mit hohem Risiko niedergelassen sind, verstärkte Sorgfaltspflichten anzuwenden. Davon erfasst sind sowohl Kunden, die ihren (Wohn-)Sitz in einem solchen Drittland haben als auch Geschäftsbeziehungen oder (gelegentliche) Transaktionen, die einen Anknüpfungspunkt zu einem solchen Drittland aufweisen.
Welche Länder in den Anwendungsbereich fallen, wird für den gesamten EWR durch eine delegierte Verordnung festgelegt. Siehe dazu den Anhang zu Del VO (EU) 2016/1675 in der jeweils aktuellen Fassung.
Darüber hinaus haben Verpflichtete sowohl im Rahmen ihrer Unternehmens- als auch im Rahmen ihrer Kundenrisikoanalyse das geographische Risiko entsprechend zu berücksichtigen.
